Paid Family & Medical Leave Update

ESD has updated its Paid Family and Medical Leave Program Employer Toolkit and has released the second draft of the phase six Paid Family and Medical Leave rules.

The Employment Security Department (ESD) has updated its Paid Family and Medical Leave Program Employer Toolkit. The latest update includes additional information regarding the employer reporting process.

Additionally, ESD has released the second draft of the phase six Paid Family and Medical Leave rules

The proposed rules include language addressing the appeals process for the program and language amending employer voluntary plan information. The new rules also incorporate changes resulting from the 2019 Legislative Session. 

Legislative updates include changing the time an employee must wait to receive benefits from the first 7 days of leave to the first 7 consecutive calendar days, allowing an employer to waive certain employee notice requirements, such as providing 30-day notice when leave is foreseeable, and stipulating that an employee cannot work and receive benefits at the same time. Employers will now also have the option to offer company provided paid leave on top of an employee’s Paid Family and Medical Leave benefit.
