Paid Family & Medical Leave Rulemaking Update 

The ESD has filed new rules regarding privacy provisions. The draft rules are independent of the previous “phase” process that has been used up to this point in the Paid Family & Medical Leave rulemaking.

The proposed updates are a result of legislation passed during the 2019 legislative session. The draft rules lay out how an individual may request Paid Family & Medical Leave records from the ESD as well as outlining the steps that must be taken should a misuse or unauthorized disclosure of program information take place. 

In addition to privacy provisions, the proposed rules define the waiting period before an employee can receive benefits as “the first seven consecutive calendar days beginning with the Sunday of the first week an eligible employee starts taking paid family or medical leave” and lay out additional requirements for the waiting period. The proposal also distinguishes when an employer must provide a continuation of benefits to an employee that is on Paid Family & Medical Leave.
