Denial of Access to Patient Records

Dentists may deny requests for patient records, in whole or in part, according to state RCW 70.02.090 and HIPAA 45 CFR 164.524. Access to records can be denied only when the dentist believes that the information in the record may result in danger to the life and physical safety of any individual or when otherwise prohibited by law.

Read RCW 70.02.090 or HIPAA: enter Title 45, Part 164, Section 524.

Access to records may not be withheld pending payment of the patient's account.
